Terms of Service

These Terms of Service ("Terms") govern your use of the Kumkwat Delivery mobile application (the "App") provided by Kumkwat Labs, LLC ("we," "our," or "us"). By using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years old to use the App. If you are under the age of majority in your jurisdiction, you must have permission from a parent or legal guardian.

2. User Accounts

To access certain features, you must create an account by signing in with a supported provider (e.g., Google, Apple). You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

3. Usage Limits

Depending on your account status, feature access and usage limits may apply. Premium features such as route optimization, CSV export, and data sync require an active subscription.

4. Subscriptions & Payments

Purchases and subscriptions are managed by your app store provider. You are responsible for managing your subscription, including cancellations. Refunds are subject to the app store’s policies.

5. Acceptable Use

You agree not to:

• Use the App for illegal or unauthorized purposes
• Reverse engineer, copy, or modify the App
• Circumvent usage limits or attempt to abuse the API
• Use the App to store or distribute harmful or malicious content

6. Data Usage & Privacy

Your use of the App is subject to our Privacy Policy, which explains how we collect and use your data. By using the App, you consent to our data practices as outlined in the Privacy Policy.

7. Third-Party Services

We integrate third-party services such as Mapbox, Supabase, and RevenueCat. These services are subject to their own terms and privacy policies.

8. Intellectual Property

All content, branding, and functionality in the App is the property of Kumkwat Labs, LLC or its licensors. You may not copy, reuse, or distribute the App content without our permission.

9. Termination

We may suspend or terminate your access to the App at any time if we believe you have violated these Terms. You may stop using the App at any time.

10. Disclaimer of Warranties

The App is provided “as is” without warranties of any kind. While we strive to keep the App secure and implement industry-standard security measures, we do not guarantee uninterrupted access, error-free performance, or the security of data transmitted to or from our servers.

11. Limitation of Liability

To the fullest extent permitted by law, Kumkwat Labs, LLC will not be liable for any indirect, incidental, or consequential damages arising from your use of the App.

12. Changes to These Terms

We may update these Terms from time to time. Continued use of the App after any changes means you accept the updated Terms.
